Vide the present petition, petitioners seek direction for quashing of FIR No.0411/2018 dated 03.09.2018 registered at Police Station Tilak Nagar,
Delhi and consequent proceedings arising therefrom.
Notice issued.
Notice is accepted by learned APP for State and by learned counsel for respondent no.2 present in person and with the consent of counsel for
parties, present petition is taken up for final disposal.
Petitioner no.1 and respondent no.2 got married on 08.02.2009 as per Sikh rites and ceremonies. Due to extreme incompatibilities between
petitioners and respondent no.2, they started living separately from 12.01.2017.
Petitioners and respondent no.2 with the intervention of their well wishers and relatives entered into an amicable settlement before the Counselling
Cell, Family Courts, Tis Hazari, Delhi vide settlement deed dated 11.07.2019 and settled all their disputes amicably.
Petitioner No.1 has handed over a demand draft bearing No.753183 dated 13.10.2020 for an amount of Rs.2,20,000/- towards the balance of the
settlement amount to respondent No.2 in the Court today.
Complainant is present in person who has been identified by SI Ankur Ohlan /IO and submits that matter has been settled and she has received the
full and final settlement amount and nothing is due from the settlement amount. She further submits that she does not wish to prosecute the matter any
further.
Taking into account the aforesaid facts, this Court is inclined to quash FIR as no useful purpose would be served in prosecuting petitioners any
further.
For the reasons afore-recorded, FIR No.0411/2018 dated 03.09.2018 registered at Police Station Tilak Nagar, Delhi and consequent proceedings
emanating therefrom are quashed.
The petition is, accordingly, allowed and disposed of.
The order be uploaded on the website forthwith.
