The present writ petition has been filed under Article 226 of the Constitution of India with the following prayers : -

“(I) Issue a writ, order or direction in the nature of certiorari quashing the impugned orders dated 20.05.2024 respectively, [Annexure No. 4 (Colly) to this writ petition] passed by respondent University or declare it as an arbitrary, illegal and unconstitutional.

(II) A writ, order or direction in the nature of mandamus commanding the Respondents to re-consider the case of the petitioners for regularize their services in pursuant to the "Daily wages, Work charge, Contractual, Fixed pay, Part time and Ad-hoc Regularization Rules 2013" or Rules are applicable in the respondent University.

(III) Issue any suitable order or direction as this Hon'ble Court may deem fit and proper in the circumstance of the case.

(IV) To Award the cost of the writ petition to the petitioners.”

Heard Mr. Harendra Belwal, learned counsel with Mr. R.K. Chauhan, learned counsel for the petitioners, Mr. B.S. Koranga, learned Brief Holder for the respondent no.1 and Mr. Shubhang Dobhal, learned counsel for the respondent nos. 2 & 3.

Mr. Harendra Belwal, Advocate, has submitted that the present matter is squarely covered by the judgment dated 06.01.2025, passed by the Coordinate Bench of this Court in WPSS No. 436 of 2024, “Ajay Kumar and Others Vs. State of Uttarakhand and Others”, and by the order dated 24.02.2025, passed by the Coordinate Bench in Writ Petition No.212 of 2025 (S/ S), “Sunita Yadav and Another Vs. State of Uttarakhand and Others”.

Learned counsel for the respondents have admitted that the present matter is covered by the judgment dated 06.01.2025 and the order dated 24.02.2025.

On the request of both the parties, the present writ petition (WPSS No.156 of 2025) is decided in terms of the judgment dated 06.01.2025, passed in WPSS No. 436 of 2024, “Ajay Kumar and Others Vs. State of Uttarakhand and Others”, and connected cases and order dated 24.02.2025, passed by the Coordinate Bench in Writ Petition No.212 of 2025 (S/ S), “Sunita Yadav and Another Vs. State of Uttarakhand and Others”.
