Judgment
S.S. Saron, J.—The petitioners are a newly married couple. They had a liking for each other and, therefore, they on their own have solemnized their marriage amongst themselves. The marriage was solemnized at Gurudwara Shri Akalgarh Sahib, Village Karora, District Mohali on 7.9.2010 as per Sikh rites. The certificate of Anand Karaj (Annexure-P.3) issued by Head Granthi of Gurudwara Shri Akalgarh Sahib and photographs (Annexure-P.4) have been placed on record. The marriage that has been solemnized is not to the liking of the parents (respondents No. 4 and 5) of petitioner No. 1. The petitioner No. 1 had submitted an application on 5.9.2010 (Annexure-P.5) to the Superintendent of Police, Karnal (respondent No. 2) and S.H.O. Police Station Nissing (respondent No. 3) submitting that she (petitioner No. 2) was a major and wanted to solemnize her marriage with petitioner No. 1 against the wishes of her parents. They had left their house under the threat of their parents and now they were living together. It is thereafter that they have solemnized their marriage on 7.9.2010. The petitioners apprehending the danger to their life and liberty have filed the present petition.
It is submitted that the petitioners are major. As per the character certificate (Annexure-P.1) issued by M.S. Public Senior Secondary School, Nissing (Karnal), the date of birth of petitioner No. 1 is 10.10.1991. The date of birth of petitioner No. 2 as per his Matric Examination certificate (Annexure-P.2) issued by the Board of School Education Haryana is 15.4.1988. The averments made in the petition are supported by an affidavit of petitioner No. 1.
Both the petitioners are present in Court and are identified by their counsel. It is stated by petitioner No. 1 that she has solemnized her marriage with petitioner No. 2 of her own free will and desire and without any kind of pressure or undue influence. Besides, she is happy with her marriage. It is submitted by both the petitioners that they were not earlier married.
In the afore-noticed facts and circumstances, the present criminal miscellaneous petition is disposed of with a direction to respondents No. 2 and 3 that in case the petitioners approach any of them setting out their grievances as have been made in the present petition the same shall be duly considered and looked into by them independently and in accordance with law.
