Harpreet Kaur and Another vs State of Punjab and Others

The petitioners have filed this petition under Section 482 of the Code of Criminal Procedure, 1973 for issuance of directions to official respondents to

protect their life and liberty from the hands of private respondents.

Petitioners have solemnized their marriage on 14.05.2018. Factum of marriage has been pleaded with reference to photographs (Annexure P-3).

Petitioners have an apprehension at the hands of private respondents and in this regard they have submitted a representation dated 14.05.2018

(Annexure P-4) to the Senior Superintendent of Police-Rural, District Amritsar Rural-respondent No.2, but no action has been taken so far.

Mr. Nikhil Chopra, Additional Advocate General, Punjab on instructions from S.I. Mehar Singh submits that in pursuance to the order dated

01.06.2018 father of the girl had disowned petitioner No.1.

Learned counsel appearing on behalf of the petitioners submitted that in view of such circumstances, order of this Court granting the custody of

petitioner No. 1 to the father should not come into the way.

I am of the view that once the father has disowned petitioner No. 1, no useful purpose would be served in implementing the order dated 01.06.2018 of

this Court. It has been brought to the notice of this Court that petitioner No. 1 is staying with petitioner No. 2 after performance of the marriage.

The present petition is disposed of with the direction to the Senior Superintendent of Police, District Amritsar Rural-respondent No.2 to look into the

representation of the petitioners and decide the same and if required, provide the protection to the life and liberty of the petitioners by providing

adequate security.

The Criminal Misc. petition stands disposed of.
