Petitioner was an accused in Crime No.72/2026 registered by Halasuru Police Station, Halasurgate Sub-Division, Bengaluru City, Bengaluru for the offences punishable under Sections 7 and 8 of Protection of Children from Sexual Offences Act, 2012 is before this Court seeking grant of regular bail.
Charge sheet has been filed. Allegation against accused is that when defacto complainant was away, accused had taken the victim girl on the pretext of giving her Good-day biscuit and kissed on her cheek, which was seen by the neighbour who raised alarm resulting in defacto complainant filing the complaint for the offences as noted above.
Learned counsel for the petitioner draws attention of this Court to the statement of the victim who has stated that she was under impression of accused being the grand-father who kissed on her cheek.
Heard. Perused the records.
Since charge sheet is already filed and in the light of the aforesaid facts and circumstances particularly nature of allegation and the age of the accused being 66 years, this Court deems it appropriate to grant bail as sought for.
Accordingly, following;
ORDER
(i) Petition is allowed.
(i) The accused/petitioner is directed to be enlarged on bail in Crime No.72/2026 registered by Halasuru Police Station, Halasurgate Sub-Division, Bengaluru City, Bengaluru for the offences punishable under Sections 7 and 8 of Protection of Children from Sexual Offences Act, 2012, subject to the following conditions:
a) the accused/petitioner shall execute personal bond for a sum of Rs.1,00,000/- with one local surety for the likesum, to the satisfaction of the jurisdictional Court;
b) The accused/petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The accused/petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The accused/petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
e) Communicate copy of this order to the trial Court and concerned prison authorities forthwith.
