Counsel for the petitioner Ms. Jasvindar Mazumdar seeks permission to withdraw this writ petition to get the dispute involved in this case resolved

through alternative mechanism. She submits that the bank guarantee which was furnished by the petitioner dated 25.10.2011 has now been extended

till 31.12.2019 and as the petitioner is willing to get the dispute resolved through alternative mechanism, the respondents herein may not invoke the

bank guarantee only for a period of two weeks from today.

The petitioner has produced a copy of the letter dated 27.12.2018 issued by Indian Bank, Kolkata extending the bank guarantee till 31.12.2019.

Counsel appearing on behalf of the respondents does not dispute the fact that the bank guarantee has been extended till 31.12.2019.

The said letter dated 27.12.2018 is taken on record.

Counsel for the respondents Mr. Amit Kumar Das submits that the period of agreement involved in this case has already expired and for all

practical purposes, the instant writ petition has become infructuous. However, he has no objection if the petitioner withdraws this writ petition.

After hearing the counsel for the parties, the petitioner is permitted to withdraw this writ petition with a liberty to get his grievances redressed

through alternative mechanism and as the petitioner has expressed the desire to get the dispute resolved through alternative mechanism, the

respondents are directed not to invoke the bank guarantee only for a period of two weeks from today.

This writ petition is accordingly dismissed as withdrawn with the aforesaid observations and directions.

The interim order, if any, stands vacated.

Pending interlocutory applications are dismissed as not pressed.
