Seeking recalling the order dated 3.7.2020, whereby this Court had dismissed the review petition, the review petitioner had come up again before this Court, on the ground that on 3.7.2020, when the said review petition was taken up, the counsel for the petitioner could not participate or argue his petition due to fault in video conferencing connectivity.

The petitioner is seeking relief in terms of the order dated 11.8.2020, passed in CWP No.2783 of 2020, titled Rulia Ram vs. H.P.T.D.C & Another, on the ground that he is similarly situated and on the ground of parity, he is also entitled to similar treatment.

Mr. Naresh Kaul, learned counsel representing the respondent did not dispute that the case of the petitioner is similar to the petitioner in CWP No. 2783 of 2020. Learned counsel also did not dispute that the counsel for the petitioner could not connect the hearing through video conferencing on 3.7.2020.

The Court proceedings are convened through video conferencing to ensure that the Court work continue despite Covid-19 pandemic and simultaneously social distance is also maintained. Given the lack of experience in conducting matters through video conferencing and lack of knowledge of technology, it is usual for lawyers, in not able to connect on time, or forgetting to unmute themselves, and other disturbances due to low band birth of the internet connection at any end.

Thus we allow this application and recall the order dated 3.7.2020.

Consequently, we allow the Review Petition No.12 of 2020 and grant the similar relief to the petitioner as was granted to the similarly situated persons in CWP No. 2783 of 2020. Let the respondents release the 50% of such benefits within two weeks from today along with statutory interest accrued upon the entire amount and the remaining amount along with statutory interest within two months thereafter. We direct the respondent-Corporation to file compliance report within three months from today. Pending application(s), if any, are closed.
