The present is a third bail application. The applicant has preferred this bail application under Section 439 of Cr.P.C. in connection with Crime No. 264/2018 registered at Police Station Surajpur, District- Surajpur (C.G.) for the offence punishable under Sections 307 of I.P.C. and Section 25/27 of Arms Act.
Present applicant is in jail since 29/06/2017.
The previous two bail applications stood rejected on 06/12/2017 and 04/07/2018. The repeat bail application has been filed only on the ground of delay in the conclusion of the Trial Court.
Having perused the previous two rejection orders, it reflects that the evidence adduced during the course of trial and also taking into consideration the role attributed upon the present applicant in commission of the offence, this Court does not find any change of circumstances as of now for reconsidering the claim of the petitioner for grant of bail. Accordingly the present bail application stands rejected.
However, the Trial Court is directed to ensure that the trial is concluded at the earliest considering the period of custody of the present applicant.
With the aforesaid observations, the bail application stands rejected.
