Justice Kurian Joseph, C.J.—Petitioner is denied regularisation on the ground that he does not possess the requisite qualification. Regularisation is in the post of Beldar. The petitioner has been working as Beldar on daily wage basis ever since 1995. The Apex Court in Bhagwati Prasad Vs. Delhi State Mineral Development Corporation, has held that in the cases of such Class-IV employees, there shall be no insistence for educational qualification in terms of the Recruitment and Promotion Rules at the time of regularisation in case they have been working for quite long. Annexure P-2, representation is pending before the 2nd respondent. There will be a direction to the 2nd respondent to take appropriate action in the light of above observation in the case of petitioner and pass final orders in the matter of regularisation positively within a period of two months from the date of production of a copy of this judgment by the petitioner before the 2nd respondent.

In view of the above, the writ petition is disposed of. Pending application(s), if any, shall also stand disposed of.
