The Respondent No.1 issued Advertisement No.01/2010 with opening date 22nd February, 2010 inviting applications for various posts in TGT (SST) (Male) under Post Code No.09/10.
The applicant claiming to be eligible applied for the said post under SC Category. The Respondent No.1 issued an addendum to Advertisement No.01/2010 adding some vacancies to various advertised categories. The examination was to be conducted in two tier system. The first tier was preliminary (objective type) and tier two was main examination (descriptive type). Both the examinations were held on the same date. The applicant having been allotted Roll No.05912708 appeared for the Post Code No.09/10. The result of the said examination was declared and the applicant secured 74 marks (Annexure A/3). The cut off mark for the said post was 70.
The respondent No.1 published a Notice dated 17.05.2016 on its website notifying a list of 357 shortlisted candidates for verification of their documents. The roll number of the applicant was included in the said list. It is stated that the applicant submitted his documents in the office of respondent No.1 on 24.05.2016 for verification. The respondent No.1 issued Result Notice No.530 dated 10.07.2017 in continuance of its earlier Result Notice No.412 dated 18.07.2016 and Result Notice No.464 dated 06.01.2017 for the post code 09/10 notifying a list of eligible and provisionally selected candidates for the said post code under Scheduled Caste category. The applicant's name is not included in the said list. The applicant submitted his representation dated 26.07.2017 regarding Post Code 09/10 for disclosing his result on the basis of the marks secured by him. The respondents have, however, not considered the same.
This Application has been filed seeking a direction to respondent No.1 to include the name of the applicant for the Post Code 09/10 of TGT (SST) (Male) in SC Category in the Result Notice No.530 dated 10.07.2017, and for consequential reliefs of his appointment to the post, seniority, pay fixation etc.
Despite opportunities, reply has not been filed.
In view of the facts and circumstances of this case, this OA is disposed of with a direction to respondent No.1 to consider the claim of the applicant for his appointment to the post of TGT (SST) (Male) under Post Code 09/10 on the basis of his merit in the examination for the said post, and if there is any deficiency of verification of the documents, the same may be communicated to the applicant within two weeks. The applicant shall submit all documents within two weeks thereafter, and if on the merit of the applicant he is found entitled to be selected/appointed, consequential orders shall be issued for this purpose within a period of two weeks thereafter. Needless to say that the applicant would be entitled to seniority as per his merit in the selection process. However, the financial benefits would be available to the applicant from the date of her appointment.
