Judgment
R.S. Garg, J.—The notice, an Advocate practising in this Court is present in person.
On 29.7.2003 when this Court was busy hearing C.W.J.C. No. 2455/2003 a mobile phone started ringing in the Court and disturbed the court work, therefore, this Court issued a notice to Mr. Ashok Kumar Singh as to why contempt proceedings be not initiated against him. The notice has filed his show cause. He has tendered unqualified apology and has also stated the reasons which led to ringing of the mobile phone in the court room.
This Court in no uncertain terms wants to say that whenever a mobile phone starts ringing in the Court the same distracts the attention of the Court and, in fact, tantamounts to causing hindrance in the dispensation of justice. Whether the cell phone belongs to a lawyer, litigant, party or anybody present in the court, it is supposed to be switched off so that such ringing of the mobile phone does not divert the attention of the Court nor does cause any disturbance in the judicial proceedings. As the notice himself has shown the reasons for the said untoward incident, I accept his apology and discharge the notice.
The Registrar General of the Court is hereby directed to display a notice on the Notice Board in the court campus or at a conspicuous place inviting attention of the lawyers, litigants and all persons, who are coming to the Court that before entering the Court rooms, they must ensure that their mobile phones are switched off. The mobile phone of Mr. Ashok Kumar Singh which is in custody of the Registrar General may be returned back to the notice.
The petition is disposed of.
