Ishwar Singh Grewal vs State of Haryana and others

Augustine George Masih, J.—Petitioner has approached this Court with a grievance that although, the benefits which he was entitled to as per the un-revised pay scale, have been released to him, but the retrial benefits after the pay revision came into effect with force from 1.1.2006 have not been released to him till date. Claiming the said benefit, the petitioner had submitted a representation dated 2.11.2011 (Annexure-P-3) to the Financial Commissioner and Principal Secretary, Cooperation Department, Haryana-respondent No. 1, which has still not been considered and decided. Counsel for the petitioner submits that the petitioner, at this stage, will be satisfied, if a direction is issued to the Financial Commissioner and Principal Secretary, Cooperation Department, Haryana-respondent No. 1 to consider and decide the claim of the petitioner as submitted by him through his representation dated 2.11.2011 (Annexure-P-3) within some specified time.

Without going into the merits of the case or commenting thereon, this petition is disposed of with a direction to the to the Financial Commissioner and Principal Secretary, Cooperation Department, Haryana-respondent No. 1 to consider and decide the claim of the petitioner as submitted by him through his representation dated 2.11.2011 (Annexure-P-3) within a period of three months from the date of receipt of certified copy of this order. The decision so taken be conveyed to the petitioner forthwith. In case the petitioner is held entitled to the benefit as claimed by him through his representation dated 2.11.2011 (Annexure-P-3), consequential benefits be granted to the petitioner within a further period of two months. If the claim as projected by the petitioner through his aforesaid representation is not to be accepted, then a speaking and well reasoned order be passed by respondent No. 1 and the same be conveyed to the petitioner forthwith.
