In view of our order passed in CP (IB) No.228/ALD/2018, admitting the corporate debtor into CIRP, this application has become infructuous. The operational creditor may approach the IRP/ RP and file its claim in accordance with the provision of IBC, 2016 and regulations made thereunder.

In case CIRP is set aside by any authority then the operational creditor herein shall be at liberty to get this application revived at its original stage.
3.
Accordingly, CP (IB) No. 05/ALD/2021 is dismissed as infructuous.
