Jagjit Kaur vs Harcharan Singh

L.N. Mittal, J.—With the intervention of the Court, parties have arrived at amicable settlement. Joint statement of parties along with Appellant''s husband has been recorded separately and is reproduced as under:

With the intervention of the Court, we have arrived at amicable settlement. Pursuant to compromise, Appellant and her husband have given one cheque dated 12.10.2010 for Rs. 1,00,000/- and another post-dated cheque dated 15.12.2010 for Rs. 2,00,000/- from the bank account of Appellant''s husband Paramjit Singh in favour of Respondent Harcharan Singh in full and final satisfaction of his claim and on receipt of amounts of the said cheques, Respondent-Plaintiff shall be responsible to keep custody of Ritu @ Gurjit Kaur (of unsound mind) - Appellant''s daughter from her first husband, and to maintain her and the suit filed by the Respondent shall stand dismissed by acceptance of this appeal. However, if either of the two cheques is dishonoured, the appeal shall be deemed to have been dismissed.

The appeal be disposed of accordingly.

The case has thus been lawfully compromised. In view of compromise, the instant second appeal is disposed of in terms of the above statement, which shall also form part of the decree sheet.
