This writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of Habeas Corpus with a roving writ, the Warrant Officer may kindly be appointed to visit the spot or issuance of direction to respondents no. 1 to 3 to produce/release the detenue (daughter of the petitioner namely Sahina (aged 17 years) and be produced in court from the illegal custody of respondent nos. 4 to 6, who had illegally detained the daughter of petitioner at some unknown place by using force upon her.

Today the detenue -daughter of the petitioner, namely Sahina (aged 17 years) has been produced by Inspector Jitender Kumar in Court. She submits that she wants to go with her father. In this regard statements of petitioner and the detenue are recorded and is reproduced hereinbelow :-

STATEMENT OF JAHEER S/O NAJEER, AGED 36 YEARS, R/O H.NO. 436, NEAR JUMMA MASJID, RAWTYA MOHALLA, NAUSHERA (142) MEWAT, HARYANA PRESENTLY RESIDING AT WARD NO. 6, MADINA COLONY, TEHSIL, NUH, DISTRICT NUH.

ON S.A.

It is stated that I am willing to take my daughter who is present in court and I will take care of my Daughter Sahina with affection and love.

The afore-said statement of mine is without any fear, coercion or undue influence.

STATEMENT OF SAHINA AGED 17 YEARS R/O H.NO. 436, NEAR JUMMA MASJID, RAWTYA MOHALLA, NAUSHERA (142) MEWAT, HARYANA PRESENTLY RESIDING AT WARD NO. 6, MADINA COLONY, TEHSIL, NUH, DISTRICT NUH.

I voluntarily want to go with my father Mr. Jaheer who is present in

Court.

The afore-said statement of mine is without any fear, coercion or undue influence.

In view of the above statements made by petitioner and the detenue, the detenue is handed over to the petitioner, hence, no cause of action survives in the present petition.

Petition stands disposed of.
