Judgment
Apprehending their arrest in connection with Pakur (M) P.S. Case No.41 of 2017 instituted under Sections 406/34 of the Indian Penal Code and Section 7 of the E.C. Act, the petitioners have moved this Court for grant of privileges of anticipatory bail.
Heard learned counsel appearing for the petitioners and learned Addl.P.P. appearing for the State.
Learned counsel appearing for the petitioners submitted that it is alleged that the petitioners along with other co-accused persons of this case indulge in black- marketing of ready to eat food supplied for the ''Aanganwari Centres''. It is submitted that the allegations against the petitioners are false and they have falsely been instituted in this case. It is further submitted that the other co-accused namely Rumala Bibi has already been granted the privileges of anticipatory bail by this Court vide order dated 12.06.2017 in A.B.A. No.3184 of 2017. The petitioners are ready and willing to deposit sufficient amount of cash security. Hence, the petitioners may be given the privileges of anticipatory bail.
Learned Addl.P.P appearing for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions of learned counsels and the facts and circumstances stated above, I am inclined to grant privileges of anticipatory bail to the petitioners. Accordingly, the petitioners are directed to surrender in the Court of learned Sub-divisional Judicial Magistrate, Pakur within four weeks from today and in the event of their arrest or surrendering, they will be enlarged on bail on depositing Rs.2,500/- (Rupees two thousand five hundred) each as cash security and on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Pakur in connection with Pakur (M) P.S. Case No.41 of 2017 corresponding to G.R. No.210 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
