The petitioner is seeking anticipatory bail in FIR No.12 dated 15.02.2020, under Sections 341, 353, 186, 427, 225, 148, 149 IPC (Section 307 IPC and Sections 25/27/54/59 of the Arms Act added later on), registered at Police Station Mamdot, District Ferozepur.
Learned counsel for the petitioner contends that the petitioner has been falsely implicated and the prosecution story has been concocted inasmuch as the petitioner along with co-accused had never been arrested and therefore, the allegations of his escape from police custody with the help of other accused stands falsified.
Learned State counsel, while referring to the status report filed by Deputy Superintendent of Police(SD), Ferozepur, contends that the petitioner had been arrested on 14.02.2020 and on their way back from CIA Staff, Ferozepur, when the police party had reached Ferozepur-Fazilka Road, two other cars approached and several persons got down and after an altercation and man-handling with the police, the petitioner had been released from police custody. He, upon instructions from SI Ravipal, contents that the petitioner was earlier declared as a proclaimed offender in FIR No.76 dated 08.07.2017, under Sections 307, 379, 323, 324, 148, 149 IPC and Section 25/27 of the Arms Act, registered at Police Station Lakho Ke Behram.
In view of the serious allegations against the petitioner having escaped from the police custody, I do not deem it appropriate to grant him the concession of anticipatory bail.
Consequently, the petition stands dismissed.
