Judgment
Mr. Panigrahi, learned advocate appears on behalf of petitioners and submits, his clients got themselves added as parties in the proceeding under section 41 of Odisha Hindu Religious Endowments Act, 1951. Now, during pendency, there is movement to seek disbursement of the compensation. His clients want that there be adjudication in the proceeding first and till then there be no disbursement. He submits further, he has served copy on Mr. Nath, learned advocate, who usually appears on behalf of the Commissioner (opposite party no.1). He hands up acknowledgment of receipt on the service.
Issue notice along with this order on the writ petition and the I.A. on opposite party nos. 5 to 24 by registered/speed post with AD. Petitioners will put in requisites on one set of process fee against each noticed opposite party.
Petitioners will also communicate this order to Mr. Nath. It is expected that copy of the writ petition already served on him will be acted upon by him or handed over to the appointed learned advocate for conducting the Commissioner’s case in this writ petition.
List on 17th April, 2023. Disbursement of compensation is not to be made till next date of hearing.
