It is apparent from the records that earlier also interim bail, on the basis of illness, was granted to the petitioner and he has not misused that concession of bail granted to him. State counsel very fairly conceded that petitioner is ill and he needs surgery (photocopy of opinion given by the jail doctor has been placed on record). It has also been brought to the notice of this court that trial is now fixed for 12.3.2003 and only four PWs remain to be examined. Keeping in view facts and circumstances of this case, four months interim bail is granted to the petitioner to the satisfaction of the trial court. However, it is made clear that he should appear on the date fixed before the trial Court or he will move an application for his exemption, as per law.
Application stands disposed of.
