M.D. Shah, J.—By way of this Appeal From Order, the appellants challenge the order dated 4.7.2006 passed below Exhibit 5 in Special Civil Suit No. 220 of 2004 by the learned Principal Senior Civil Judge, Surat. On 27.2.2007, this Court has passed following order :

RULE returnable on 12th March, 2007. Till then, the respondents are directed to maintain status quo prevailing as on today. Direct service is permitted.

Learned advocates appearing on behalf of respective parties state that if the above referred order will be continued till final disposal of the suit and necessary direction may be issued to the trial Court for expeditious disposal of the suit, then no reasoned order is required to be passed in this matter.

Considering the facts and circumstances, learned Principal Senior Civil Judge, Surat is directed to finally decide and dispose of Special Civil Suit No. 220 of 2004 on its own merits and in accordance with law, within a period of nine months from this order, without being influenced by this order. The order passed by this Court on 27.2.2007 shall remain in force till final disposal of the Special Civil Suit No. 220 of 2004. Parties to the suit shall cooperate in disposal of the suit. In view of above, the Appeal From Order is disposed of accordingly, without expressing any opinion on merits. Direct service is permitted.
