By way of instant contempt petition, prayer has been made on behalf of the petitioner for initiation of contempt proceedings against the respondent, for having willfully and intentionally disobeyed order 3.6.2015 passed by erstwhile Himachal Pradesh Administrative Tribunal in OA No. 1229 of 2015 titled Kalawati vs. State of HP and others, whereby learned Tribunal below, while disposing of the Original Application having been filed by the petitioner directed the respondent authority to consider the case of the petitioner for regularisation as Beldar (Class IV) alongwith consequential benefits, if any, in light of judgment rendered by this Court in CWP No. 2735 of 2010 titled Rakesh Kumar vs. State of H.P. and others and other connected matters, decided on 28.7.2010 and to grant similar benefits, if the petitioner is found to be similarly situate.

Having carefully perused order dated 27.7.2015 passed by Director, Panchayati Raj, Himachal Pradesh, Annexure C-2, annexed with the application, this Court finds that the order alleged to have been violated in the instant proceedings stands duly complied with because, perusal of aforesaid order clearly reveals that after passing of order by learned Tribunal below, respondent/competent Authority has considered the case of the petitioner for regularisation as Beldar in terms of judgment passed by this Court in Rakesh Kumar (supra), as such, no action of the respondent can be termed to be contumacious, therefore, no fruitful purpose would be served by keeping the present proceedings alive, which are accordingly closed. Notice issued to the respondent is discharged. Liberty is reserved to the petitioner to file appropriate proceedings in appropriate court of law, for the redressal of her surviving grievance, if any.
