Pearson, J.—The value of the subject-matter in dispute in this suit appears to us to be the difference between Rs. 3,000 and Rs. 6,000 or thereabouts. We are therefore of opinion that the appeal preferred to the Zila Judge was cognizable by him, and we accordingly allow this application with costs, set aside the lower Court''s order, and direct it to replace the appeal on its file and to dispose of it according to law.
