Permission to file appeal is granted.

We have heard learned counsel for the parties at length.

We are of the opinion that the Armed Forces Tribunal has rightly granted Special Family Pension and limited the arrears to the period starting from three years prior to filing of the O.A. We are also of the opinion that the case of the appellant is not covered by Liberalised Family Pension. However, having regard to the manner in which the appellant was pitted and was given the justice by the Armed Forces Tribunal in granting her the Special Family Pension at such a belated stage, we are of the opinion that cost should have also been imposed upon the respondents. The respondents shall, accordingly, pay a sum of rupees one lakh, as costs, to the appellant within a period of four weeks.

The appeal stands disposed of as indicated above.

Pending applications, if any, shall also stand disposed of.
