This Criminal Petition has been filed by the petitioners/accused Nos.9, 13 and 16 seeking a direction to the learned Principal Sen or Civil Judge-cum-Assistant Sessions Judge at Hanamkonda (designated Special Court for the trial of CBCID Cases), to conclude the trial and disposal of C.C.No.3 of 2018 (Old C.C. No.467 of 2010) by fixing time limit.

Heard Mr. N Ananda Rao, learned counsel for the petitioners, and Mr. Jithender Rao Veeramalla, learned Additional Public Prosecutor for respondent No.1 State.

Notice in respect of respondent No.2 is dispensed with on the ground that the petitioners are not seeking any relief against him and they are only seeking a direction to the learned trial Court for expeditious disposal of C.C.No.3 of 2018.

Learned counsel for the petitioners submitted that the Investigating Officer filed final report as long as in the year 2010 and the same was took cognizance and numbered as C.C.No.467 of 2010 and it was renumbered as C.C.No.3 of 2018 and since 2010, the matter is pending before the trial Court. He further submitted that on behalf of prosecution, most of the prosecution witnesses were already examined and the matter before the trial Court is posted for examination of panchas and Investigating Officers. However, the trial Court adjourning the matter from time to time without assigning any reasons much less valid reasons. He further submitted that petitioner Nos.1 and 3 are aged about 68 years and 60 years. Unless this Court fixes a time limit for the conclusion of the trial and disposal of C.C.No.3 of 2018, the petitioners will be put to great hardship.

Taking into consideration the peculiar facts and circumstances of the case, and the submissions made by the learned counsel for the petitioners, the trial Court is directed to conclude the trial and dispose of the C.C.No.3 of 2018 in accordance with law, as expeditiously as possible, preferably within a period of six (6) months from the date of receipt of a copy of this order. It is needless to mention that the parties in lis are directed to cooperate with the trial Court without seeking undue adjournment.

With the above said direction, the Criminal Petition is disposed of accordingly
