This writ petition is filed questioning the action of respondents in marking the properties of petitioners with an intention to demolish or dispossess them from their respective buildings bearing No.18-58 to 60; H.No.12-71 and H.No.18-53/1 and 18-53 facing Ramalayam Chowrasta to Syed Pahad Darga at Kosgi, Narayanpet, District, Telangana, under the grab of road widening without any notice, as illegal and arbitrary.

Heard learned counsel for the petitioners Mr. Rajesh Kumar Heroor, learned Government Pleader for Revenue for respondent Nos.1,4,6 and 7, learned Government Pleader for Municipal Administration and Urban Development for respondent No.2, Learned Government Pleader for Roads and Buildings for respondent Nos.3 and 5 and Mr. N. Praveen Kumar, learned Standing Counsel for respondent No.8.

When the matter came up for hearing on 27.04.2022, learned counsel for the petitioners sought time and submitted that, Yesterday, the respondents have demolished part of the shops and learned counsel has also filed the photographs before this Court.

Learned Assistant Government Pleader for Roads and Buildings, on instructions, submits that Tunkimetla Narayanpet Road from Km 18/2-20/140 and the double lining of the road along with the drains has been recently sanctioned and the work is in tender stage. He submits that no property in the widening portion of the above stretch has been demolished by the R & B Department in the recent times and the work shall be taken up following due process of law only, after concluding the agreement.

Recording the submission of the learned Assistant Government Pleader for Roads and Buildings, the Writ Petition is disposed of, directing the respondents not to interfere with the petitioners’ possession over the subject properties for any purpose without following due process of law. No order as to costs.

Miscellaneous Applications, if any pending in this writ petition, shall stand automatically closed.
