At this stage, it has been submitted by learned counsel appearing for the applicant that the applicant would be satisfied if the present application be considered, only for grant of interim bail to attend the annual religious rites of his deceased son, who, as per the bail application, expired on 24.01.2022 at PGI, Chandigarh.

The applicant has been arrested in FIR No.394/2020, dated 03.11.2020, registered under Sections 20, 25 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 and as per the status report, the contraband weighing 3.277 kilogram of Charas was allegedly recovered.

The applicant has also tried his luck by moving the bail applications before this Court, as detailed and described in para 4 of the application, but his applications were rejected by the Court.

Since the applicant has confined his prayer to attend the annual religious rites of his deceased son, as such, the Jail Authorities are directed to take the applicant to his native place at Village Ghat, Post Office Chiuni, Tehsil Thunag, District Mandi, H.P. on 23.01.2023, under proper custody and the applicant is directed to be lodged in Model Central Jail, Kanda, District Shimla under proper custody on 25.01.2023.

Police Authorities are further directed to take the applicant to his native place in the morning and lodge him back in District Jail Mandi during those two days.

With these observations, the present bail application is disposed of.
