Petitioner is aggrieved by the issuance of office order dated 16th March, 2011 (Annexure P-1), whereby she has been transferred from Regional Hospital, Bilaspur to HSC, Maleta, District Bilaspur. The petitioner has already completed her normal tenure in Regional Hospital, Bilaspur. The only ground pleaded to assail the office order dated 16th March, 2011 is that the persons with longer stay have been retained. It is for the employer to see where a particular incumbent is to be posted keeping in view the administrative exigency and larger public interest. There is no mala fide alleged by the petitioner while assailing office order dated 16th March, 2011. It is also evident from office order dated 16th March, 2011 that the petitioner was surplus. It is not only that the petitioner has been shifted, the other surplus employees have also been shifted including senior and junior to the petitioner. Consequently, in view of the observations and discussions made hereinabove, there is no merit in this petition and the same is accordingly dismissed, so also the pending application(s), if any. No costs.
