Justice Kurian Joseph, C.J.—Writ petition is filed mainly with the following prayers:- (i) That the writ in the nature of mandamus may kindly be issued directing the respondent Nos. 1 to 4 to take action against the respondent No.5 in accordance with the provisions of the Himachal Pradesh Panchayati Raj Act, 1994 and Rules framed hereunder for which the petitioners humbly pray.

(ii) That the respondent No. 5 may be put under suspension since the report submitted by the authorities clearly reveals that she has misappropriated, mis- utilized and embezzled the Panchayat funds and further the respondent No. 5 may be directed to refund the amount of Rs. 23,697/-along with interest @ 12% from the date of withdrawal of the amount till its realization for which the petitioners humbly pray.

In view of the intervening developments, in case the petitioners have still any grievance left, it will be open to them to point out the same before the third respondent, in which case the third respondent will look into the matter and take appropriate action in accordance with law, within four months, after affording an opportunity for hearing to the petitioner and affected parties.

With the aforesaid observations, the writ petition stands disposed of, so also the pending application(s), if any.
