Since these three bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties.
These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Cyber Crime (CID) PS Case No. 12 of 2025 corresponding to CT Case No.583 of 2025 pending in the file of learned SDJM, Bhubaneswar, for commission of offences punishable U/Ss. 318(2)/ 319(2)/ 336(2)/ 336(3)/ 338/ 340(2) /61(2)/ 3(5) of BNS.
These present cases arises out of Cyber Crime FIR No.12 of 2025 lodged by one Ashish Kumar Samal stating therein that he auto joined in a WhatsApp Group named “EQUITY HUB 41” and he was impressed upon by the admin to be a Wharton School graduate and a former fund manager in JP Morgan Company and believing such representation, the informant went on investing on the advice of such admin of the WhatsApp Group and in the process, he invested Rs.5Crores & 14Lakhs in 54 transactions in 8 different bank accounts and he was allocated with stocks worth Rs.12Crores, but only 5Crores in his accounts with unpaid share marked as “To Pay”, however, when the informant tried to withdraw the money, he was not allowed and thereby, he realized to be duped in a scam. After registration of the FIR, the matter was investigated into, but finding the complicity of the petitioners, they were taken into custody ultimately landing them before this Court in these bail applications.
Heard, Mr. Arijeet Mishra, learned counsel for the petitioner in BLAPL No.5129 of 2026; Ms. Manasi Sethi, learned counsel for the petitioner in BLAPL No.5672 of 2026; Mr. Amit Kumar Patra, learned counsel for the petitioner in BLAPL No.5934 of 2026 and Mr. M.R. Patra, learned Addl. PP in these matters and perused the record together with the written instruction as submitted by the IO and supplied to this Court.
After having considered the rival submissions upon perusal of record, it appears that the petitioner Koshiya Vaibhav Jitendrabhai @ V.D. Koshiya is allegedly a broker liaisoning the cyber fraudsters and the current back account holders and he had allegedly offered to co-accused Goyani Milan Bhai Bhupatbhai to handover his current account on payment of commission and after obtaining such documents, he handed over to another person at a hotel in Ahmedabad. Similarly, the allegation against the petitioners Randheer Kumar Ray and Kiran Gurung is that they came in contact with one Bablu Sarkar who induced them to open current account and use such account for transaction in lieu of commission @ 1% of the admitted transaction amount and on the instigation of Bablu Sarkar, they were being allured for transaction in their accounts for online financial fraud on the assurance of profit @ 20 to 30%, but the written instruction as produced, however, discloses that the petitioners-Randheer Kumar Ray and Kiran Gurung do not know anything about the transactions, but they have handed over their mobile sim cards to Bablu Sarkar and in the process they fell to the prey in the alleged crime.
It is also found from the record that the petitioners are in custody since 06.02.2026, 25.04.2026, 29.04.2026, but in the meantime, charge-sheet has already been submitted. Besides, co-accused Aniket Roy & Another in BLAPL No.3426 of 2026 and Goyani Milan Bhai Bhupatbhai in BLAPL No.3465 of 2026 have already been granted bail by a Coordinate Bench of this Court. Additionally, the FIR has been lodged against unknown persons. In the aforesaid facts and circumstances and considering the allegation levelled against the petitioners together with the materials collected by the Investigating Agency and the allegation against the petitioners being for facilitating use of bank accounts for online financial fraud, but they being not directly involved in any online financial fraud, this Court without expressing any view on merit admits each of the petitioners to bail.
Hence, these three bail applications of the petitioners namely Koshiya Vaibhav Jitendrabhai @ V.D. Koshiya (BLAPL No.5129 of 2026); Randheer Kumar Ray (BLAPL No.5672 of 2026) and Kiran Gurung (BLAPL No.5934 of 2026) stand allowed and each of the petitioners are allowed to go on bail on furnishing bail bonds of Rs.1,00,000/- (Rupees One Lakh) with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it.
Accordingly, these BLAPLs stand disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
