Joshi, Assistant Manager and Mr. Dashrath S. Sangwan, Admn. Officer, for respondent No.2-National Insurance Company Ltd. Present appeal has

been filed by the claimant under Section 173 of the Motor Vehicles Act, 1988 (for short 'Act') against the impugned Award dated 30.11.2007, passed

by learned Motor Accident Claims Tribunal, Bhiwani (for short 'Tribunal') for enhancement of compensation on account of the injuries sustained by

the appellant-claimant.

Today, the matter has been listed before the National Lok Adalat.

Learned Counsel for respondent No.2/Insurance Company, on instructions, has offered to pay an amount of Rs.2.00 lakh (Rupees Two Lakh Only)

over and above the compensation awarded by learned Tribunal, which is acceptable to the appellant(s)/claimant(s) as full and final settlement.

In view of the above amicable settlement between the parties, we direct respondent No.2/Insurance Company to deposit the aforesaid enhanced

amount by way of account payee cheque in favour of the appellant(s) with the Office of Lok Adalat of this Court within 45 days from today and the

same be handed over to them against proper receipt and identification. Failure thereof shall attract interest at the rate of 9% per annum from the date

of settlement till its realization. The terms and conditions of disbursal of the aforesaid enhanced amount of compensation will remain unaltered, as

passed by learned Tribunal.

FAO stands disposed off.
