Heard learned counsel for the petitioners as well as the learned counsel for the respondent State.

The prayer in this petition has been made for direction upon the respondent authority to pay the compensation to the petitioners as against the acquisition of 5 bighas of lands of plot no.1040, khata no.96, mouza Kouri Bahiar No.509/500 by the District Land Acquisition Officer, Godda (respondent no.3) for Adani Plant/Project inherited by the petitioners from their father late Kailash Pati pandey, an Ex-Military personnel in whose favour the said lands were duly settled by the Sub Divisional Officer, Godda by order dated 29.06.1970 in Settlement Case No.61A of 1968-69.

Learned counsel appearing on behalf of the petitioners submits that even the Divisional Commissioner Santhal Pargana has directed the authority concerned to make arrangement of compensation and in spite of that, it has not been done.

Learned counsel for the respondent State submits that the petitioners are required to move before the Divisional Commissioner concerned for redressal of their grievance.

In view of above, the Court finds that the Divisional Commissioner is the superior authority of the respondent concerned (resp.nos.2 and 3) and he is the competent authority to direct them to implement own order and as such the petitioners are directed to move before the Divisional Commissioner, Santhal Pargana Division and pursue the same before the Divisional Commissioner who is the superior authority of the respondent nos.2 and 3.

It is needless to say that if the petitioners will pursue the matter before the Divisional Commissioner, he will expeditiously direct to implement the order.

This petition is accordingly disposed of.

Pending petition if any also stands disposed of accordingly.
