K.S. Vijaya Kumar, Chief Accountant and All Kerala Co-operative Urban Bank vs Concurrent Auditor To Nedumangad and Nedumangad Co-operative Urban Bank Ltd.

P.N. Ravindran, J.—The first Petitioner is an employee of the second Respondent bank. The second Petitioner is an employees'' association represented by its Unit Secretary, who is also an employee of the second Respondent bank. The scale of pay of the employees of co-operative urban banks in the State of Kerala was revised by Ext.P1 Government order dated 18.8.2010 w.e.f. 1.4.2008. As per Clause 20 thereof, the pay fixation statement based on the revised scales of pay, has to be audited and certified by the concurrent auditors. It is stated that, though the pay of the first Petitioner and other employees of the second Respondent bank was revised and fixed by the managing committee pursuant to the resolution adopted by it on 12.11.2010 and the pay fixation statement was forwarded to the concurrent auditor for certification, till date the concurrent auditor has not taken any action in the matter. In this writ petition, the Petitioner seeks a direction to the first Respondent, the Concurrent Auditor of the second Respondent bank, to verify the pay fixation statement prepared by the second Respondent, to give effect to the pay revision order and to certify the same if it is found to be in order, within a time limit to be fixed by this Court.

Ext.P2 discloses that the Administrator of the second Respondent bank has on 12.11.2010 decided to implement pay revision ordered as per Ext.P1 order in respect of all the employees of the second Respondent bank. Ext.P2 series pay fixation statement was accordingly prepared and forwarded to the first Respondent, the Concurrent Auditor of the second Respondent bank. Clause 20 of Ext.P1 government order states that, ''the pay so revised will be audited and certified by the concurrent auditors of the bank''. In such circumstances, as more than two months have been passed, after Ext.P2 pay fixation statement was submitted to the first Respondent, I am of the opinion that, the first Respondent should examine the same and certify it if it is found to be in order, expeditiously.

I accordingly dispose of the writ petition with a direction to the first Respondent to examine Ext.P2 pay fixation statement and approve and verify the same, if it is in order, expeditiously and at any rate within one month from the date on which the Petitioner produces a copy of this judgment before him. The Concurrent Auditor shall after he certifies the pay fixation statement forward it to the second Respondent bank expeditiously.
