Petitioner No.1 – Kuldeep Kaur, aged about 28 years, who is stated to have been previously married to one Amandeep Singh and petitioner No.2 – Surinder Singh, aged about 37 years, who is also previously married, have approached this Court seeking issuance of a direction to official respondents to protect their lives and liberty, as they apprehend threat to the same at the hands of private respondents, who do not approve of their live-in relationship.

Notice of motion.

On the asking of the Court, Ms. Swati Batra, DAG, Punjab, who is present in Court, accepts notice on behalf of respondents No1 to 3/State.

It needs to be pointed out here that marriage of none of the petitioners is stated to have been dissolved by a decree of divorce though both claim to be residing separately from their respective spouses by mutual consent. Both of them are already blessed with children.

Without commenting as regards the veracity of the averments made in the petition, the petition is disposed of with a direction to respondent No.2 i.e. Senior Superintendent of Police, Bathinda to look into the matter and to dispose of the representation dated 07.02.2023 (Annexure P-3) in accordance with law. In case, it is found that there is a genuine threat to the lives and liberty of the petitioners, then necessary steps warranted under law be taken thereupon at the earliest so as to ensure that no harm is caused to the petitioners.

A copy of this order along with copy of the representation dated 07.02.2023 be sent to the Senior Superintendent of Police, Bathinda (respondent No.2), so as to enable him to do the needful expeditiously.

It is, however, clarified that the aforesaid order shall not confer any immunity upon the petitioners, in case it is found that they have committed any wrong.

It is further clarified that the aforesaid directions are also been issued without prejudice to the rights of the minor children of both the petitioners and it shall be their duty to look after them.
