Judgment
Surya Kant, J.—The petitioners are stated to be victims of ''1984 Anti-Sikh Riots'' to whom, pursuant to the order dated 14.9.2010 passed in Civil Writ Petition No. 16345 of 2009 (Kuljit Singh and others versus State of Punjab and another) (Annexure P-5), MIG/LIG flats have been allotted by GMADA in SAS Nagar Mohali in purposed compliance of various policy decisions taken by the Central/ State Governments. The grievance of the petitioners is that they are being asked to deposit allotment price at the rate of Rs. 34,48,000/- for MIG flats and Rs. 15,48,000/- for LIG flats whereas the same flats were allotted to the riots victims previously in SAS Nagar Mohali and in Ludhiana at very low rates including Rs. 88,000/-. It is contended that the price determined by GMADA includes element of profit in total contravention of the Government policies placed on record.
Having heard learned counsel for the petitioners and considering the nature of relief sought in this writ petition and keeping in view the categoric plea taken by the petitioners that the allotment price(s) sought to be charged by GMADA is in violation of the Government policies, we deem it appropriate to dispose of this writ petition with a direction to the Principal Secretary, Department of Home Affairs and Justice, Punjab, to treat this writ petition as a representation on behalf of the petitioners against determination of price(s) of MIG/LIG flats allegedly in violation of the Government policies, and dispose of the same by passing a speaking order as early as possible but not later than three months from the date of receiving a certified copy of this order.
Learned counsel for the petitioners undertakes to hand-over two copies of this writ petition to Ms. Monica Chhibber Sharma, learned Deputy Advocate General, Punjab, for onwards transmission to the Government.
Let a copy of this order be given dasti to Ms. Monica Chhibber Sharma, learned Deputy Advocate General, Punjab, for information and necessary compliance. Ordered accordingly.
