Kulwant Singh vs State of Punjab and Others

Nirmaljit Kaur, J.—This is a petition u/s 482 Code of Criminal Procedure for issuance of direction to Respondents No. 2 to 4 to ensure proper, fair and impartial investigation in case FIR No. 4 dated 12.03.2010 u/s 7/13(2) 88 of the Prevention of Corruption Act, P S Vigilance Bureau, Ferozepur, District Ferozepur.

Reply has been filed by the State. As per the reply, the matter was investigated by the DSP, Vigilance Bureau, Ferozepur and the cancellation report has been prepared. It is further evident from Annexure C submitted by the DSP, Vigilance Bureau, Ferozepur that the Magisterial inquiry has been done by the Sub Divisional Magistrate. This inquiry has been done as per the orders of the Deputy Commissioner, Ferozepur who is an IAS Officer. Both the officers said that Kulwant Singh complainant has got registered a false case against Baldev Singh and Dharampal Superintendent, District Magistrate, Ferozepur strongly recommended to the Principal Secretary, Punjab Government, Home and Law Department, Punjab, for the cancellation of the case.

The said cancellation report is now pending before the Chief Director Vigilance Bureau, Punjab for approval.

In view of the above, the present petition is disposed of with a direction that in case, such cancellation is submitted, the Petitioner will be at liberty to raise all the pleas and objections as raised herein before the Court where the cancellation report is submitted.
