Judgment
Heard learned Senior counsel for the petitioner and learned counsel for the Respondent-State.
The petitioner was an applicant at the 63rd Combined Competitive (Main) Examination for appointment conducted by the Bihar Public Service Commission ( hereinafter referred to as the'B.P.S.C.').
Shorn of unnecessary details, the petitioner's case is that by mistake she left the original provisional certificate of Graduation at home while going for the Interview which was scheduled to be held on 12th September, 2019.
The learned Senior counsel, representing the petitioner, submits that being a bona fide mistake, the petitioner made a plea before the Authority for being granted 45 minutes to produce the original of the provisional Graduation Certificate. Such plea of the petitioner was not acceded to and her candidature was rejected for non-production of the original testimonial being the provisional Graduation certificate. It is submitted that the petitioner produced all other original of testimonials as well as duly attested copies as per requirements contained in Clause-2 of the interview letter (Annexure-3) and as such she should have been allowed time to produce original of the provisional graduation certificate. She prays for a direction to the respondent- Commission to publish her result. Clause-2 of the Interview Letter reads as follows:-
"02. आप निम्नलिखित प्रमाण पत्र, अंक पत्र एवं अन्य कागजात मूल में अनिवार्य रूप से एवं उसकी दो स्वअभिप्रमाणित छायाप्रतियों के साथ उपस्थित रहेंगे-:
(i) जन्म तिथि के साक्ष्य (Proof of date of Birth) हेतु मैट्रिक उत्तीर्णता का मूल प्रमाण पत्र/अंक पत्र।
(ii) स्नातक की डिग्री का अंक पत्र।
(iii) स्नातक की डिग्री का प्रमाण पत्र।
(iv) पिछड़ा वर्ग/अत्यंत पिछड़ा वर्ग के उम्मीदवारों के लिए क्रीमीलेयर रहित प्रमाण पत्र (महिला उम्मीदवारों के लिए पिता के नाम एवं पता से निर्गत क्रीमीलेयर रहित प्रमाण पत्र लाना अनिवार्य है।)
(v) पिछड़ा वर्ग/अत्यंत पिछड़ा वर्ग के उम्मीदवारों के लिए क्रीमीलेयर के अन्तर्गत नहीं होने सम्बन्धी घोषणा पत्र (विगत 1 वर्ष से पूर्व का क्रीमीलेयर रहित प्रमाण पत्र होने पर )।
(vi) अनुसूचित जाति/अनुसूचित जनजाति के उम्मीदवारों के लिए जाति प्रमाण पत्र एवं स्थायी निवास (महिला उम्मीदवारों के लिए पिता के नाम एवं पता से निर्णत जाति प्रमाण पत्र एवं निवास पत्र लाना अनिवार्य है)।
(vii) दिव्यांगता सम्बन्धी प्रमाण पत्र की मूल प्रति (दो प्रति के अतिरिक्त एक प्रति मेडिकल बोर्ड के लिए)।
(viii) स्वतंत्रता सेनानी के पोता/पोती/नाती/नतिनी के आरक्षण का दावा करने वाले अभ्यर्थियों के लिए जिला पदाधिकारी या उनके द्वारा मनोनीत पदाधिकारी द्वारा विहित प्रपत्र में निर्गत प्रमाण पत्र।
(ix) पहचान पत्र (फोटोयुक्त)।
(x) दो पासपोर्ट साईज के अद्यतन फोटोग्राफ (Recent Photograph)
साथ ही इन सभी मूल प्रमाण पत्रों एवं अंक पत्रों की छायाप्रति दो सेट में उम्मीदवारों द्वारा स्वअभिप्रमाणित कर जमा करना अनिवार्य होगा। योग्यता सम्बन्धी प्रमाण पत्र वही मान्य होंगे, जिनका उल्लेख उम्मीदवार ने प्रारम्भिक परीक्षा हेतु भरे गये आवेदन पत्र में किया है। योग्यता से सम्बन्धित प्रमाण पत्र के निर्गत होने की तिथि, प्रारम्भिक परीक्षा हेतु आवेदन प्राप्त करने की अंतिम तिथि (15.12.2017) तक का ही होना आवश्यक है।
यदि आप साक्षात्कार के दिन उपरोक्त वर्णित सभी प्रमाण पत्र मूल में प्रस्तुत नहीं करते है तो इसके लिए कोई भी अतिरिक्त समय नही दिया जाएगा। ऐसे उम्मीदवारों की अर्हता के सम्बन्ध में यथासमय समुचित निर्णय लेने के लिए आयोग स्वतंत्र होगा।"
The same lays down a non-discretionary provision which is uniformly applicable to all candidates. The Clause in itself does not allow any discretion capable of being exercised arbitrarily in individual cases where the candidates may have appeared at the Interview without any of the original testimonials or copies which were required under the said provisions. The one and only non- arbitrary consequence of such lapse is rejection of the candidature. The Clause in itself promotes fairness in the process and safeguards the interest of others who are duly diligent and appeared at the Interview along with all the requisite testimonials.
The plea raised by learned Sr. counsel invoking equity and substantial justice cannot be acceded to ignore/overcome the requirements contained in Clause-2 of the Interview Letter, having regard to the fact that it only promotes fairness and provides non-arbitrary and non-discretionary consequence of failure to produce original of testimonials which is of universal application to all the candidates appearing in the interview.
No exception thereto can be permitted.
In the aforesaid background, no enforceable claim is made for exercise of jurisdiction under Article 226 of the Constitution of India in favour of the petitioner.
The writ petition is dismissed.
