Heard Mr. C.S. Sinha, learned counsel appearing for the petitioner. Also heard Mr. K. De, learned Addl. G.A appearing for the respondents-State.

The simple case of the petitioner is that following a disciplinary proceeding penalty has been imposed upon the petitioner. He was asked to submit representation. The petitioner had prayed for some time for submitting such representation, but, that prayer for granting time was rejected by the disciplinary authority.

In my opinion, a reasonable opportunity should be provided to the petitioner to submit representation.

Accordingly, this petition is allowed directing the petitioner to submit representation, if he so desires within a period of 2(two) weeks from today.

It is made clear that if the petitioner fails to submit representation within the said period of time, then, necessary order may be passed by the disciplinary authority in accordance with law.

With the aforesaid directions, the instant writ petition stands allowed and disposed.
