Judgment
Anjuli Palo, J
This revision seems to be arguable, therefore, admitted for hearing. Heard on I.A. No. 15147/2021, which is an application for suspension of sentence
and grant of bail to the applicants.
The applicants have been convicted under Section 325/34 of the IPC and sentenced to R.I. for 6 months with fine of Rs.500/- each with default
stipulation.
Learned counsel for the applicant submits that the sentence awarded to the applicants is 6 months. The applicants were on bail during trial and they
did not misuse the liberty granted to them. The applicants are in custody and disposal of this revision would take considerable time, hence, the jail
sentence of the applicants be suspended and they be released on bail.
Learned Panel Lawyer for the State has opposed the bail application. Considering the nature of offence and period of jail sentence awarded
to the applicants, without commenting upon the merits of the case, this application is allowed subject to following conditions;-
It is directed that subject to depositing the fine amount, if not already deposited and on furnishing a personal bond in a sum of Rs.30,000/-(Rupees
Thirty Thousand Only) each with one solvent surety in the like amount to the satisfaction of the trial Court concerned, remaining jail
sentence imposed upon applicants shall remain suspended during the pendency of this case and they shall be released on bail.
The applicants shall appear before the trial Court concerned on 6.12.2021 and on all such subsequent dates, as may be fixed in this regard
during the pendency of this revision.
Record of the Courts below be requisitioned.
List for final hearing in due course.
