Judgment
Hon''ble Prafulla C. Pant, J.—Heard.
By means of this writ petition moved under Article 226 of Constitution of India, the petitioners have sought quashing of the First Information Report dated 24.09.2011, (F.I.R. No. 156 of 2011) registered at Police Station Sitarganj, District Udham Singh Nagar, relating to offence punishable u/s 3/5/11 of Uttarakhand Cow Progeny (Protection) Act, 2007.
Learned counsel for the petitioners submitted that petitioners are innocent. It is further pleaded that they have been falsely implicated.
However, the allegation in the First Information Report is that, the two persons were caught slaughtering the cow progeny animals with intention to sell the beef, and two others said to have succeeded in fleeing from the scene.
Having considered submissions of learned counsel for the petitioners, and learned counsel for the state, without expressing any opinion as to final merits in the matter, this court is not inclined to interfere with the investigation of the case.
Therefore, the writ petition is dismissed summarily with the observation that if the petitioners namely Laik Ahmad and Hasib Ahmad @ Bhura surrender before the court concerned, their bail application shall be heard and disposed of without unreasonable delay, keeping in mind that other two accused namely Ateek and Yaseen, regarding whom it is alleged that they were arrested at the spot, have already been directed to be released on bail.
