Judgment
Khem Karan, J.—Heard Shri Atul Mehra, learned Counsel for the Petitioner and the learned Counsel for the State on the application u/s 482 of the Code.
The prayer is that the Court concerned be directed to accept fresh bail bonds for the offence u/s 308/325 of I.P.C. in Crime No. 378A of 2000 police station, Handia, district Allahabad.
The learned Counsel for the applicant has submitted that the applicants were enlarged on bail in the said crime, but subsequently police added Section 308/325, I.P.C. to the Section already given in the first information report and this has necessitated the request for bail in those Sections as well.
Learned Counsel for the State has no objection if the prayer is granted. Moreover, once an accused has been released on a crime, normally the benefit of bail is not denied unless there is any serious change in the situation. So the application is allowed and the Court concerned is directed to release the applicants on the same bail bonds which have already been furnished by the applicants in the said crime without taking the applicants in physical custody.
