Applicant's mother was working as Safaiwali. Unfortunately she died on 15.12.2014 after completing 30 years of service. The applicant made a request for grant of compassionate ground appointment. The process was initiated by the respondents on 03.2.2015 by seeking details of moveable/immovable property from Tehsildar, Delhi Cantt. in the name of the applicant. The Tehsildar furnished aforementioned details on 10.9.2015. On 30.03.2016, Col. EME, HQ Branch wrote a letter to the higher authority recommending applicant's appointment on compassionate grounds.

The applicant submits that the respondents are unnecessarily delaying his claim on one pretext or the other.

Feeling aggrieved, the instant OA has been preferred. The applicant sought relief for a direction to the respondents to consider his case for compassionate ground appointment. The matter has been heard at the admission stage.

It is seen that the applicant's case for grant of compassionate ground appointment is already under consideration of the respondents. However, final order has not been passed as yet. Through letter dated 14.12.2020, the respondents have sought some fresh documents from the applicant.

In view of the forgoing, no useful purpose will be served to keep the OA pending. OA is disposed off at the admission stage, without going into merits of the case, with a direction to the respondents to pass a reasoned and speaking order after consideration of the request of the applicant for grant of compassionate ground appointment, keeping in view all the extant rules and instructions on the subject, within a time period of 12 weeks, under advice to the applicant. The applicant shall have liberty to approach the Tribunal if certain grievance still subsists. No costs.
