Laxmi Narayan Meena and Another vs State of Rajathan and Others

Alok Sharma, J.—In this writ petition, the petitioners have prayed that respondents be directed to release the marksheets of the petitioners for the examination of NCVT, in which they appeared under order dated 19-1-2011 passed by this court.

The facts of the case are that owing to an affiliation dispute between the Kanika Industrial Training Center and the Director Technical Education, Directorate Jodhpur, a writ petition No.14460/2010 came to be filed by Kanika Industrial Training Center before this court, and this court vide order dated 19-12011, allowed the students of Kanika Industrial Training Center to write the NCVT Examination 2011 in Electronic trade provisionally.

Subsequently, the affiliation dispute between the Kanika Industrial Training Center and the Director Technical Education, Directorate Jodhpur was resolved and the result of the petitioners was declared wherein they were found to have failed in the examination, but the mark-sheet of the petitioners has not been issued, in spite of their best efforts.

In this view of the matters, the petitioners filed representations for the release of their mark-sheets before the Director Technical Education, Directorate Jodhpur as also the Kanika Industrial Training Center. Yet the petitioners'' mark-sheets for the NCVT Examination 2011, was continued to be withheld.

It is submitted by the petitioners that as such the petitioners cannot apply and avail of any second chance to appear in the further NCVT Examinations.

Heard the petitioners, and perused the material available on record of writ petition.

On consideration of the matter, I am of the view that the prayer of the petitioners is innocuous. As the petitioners have written the NCVT Examination 2011 under order dated 19-1-2011 passed by this court in writ petition No.14460/2010, and there is no subsisting dispute with regard to the affiliation of the Kanika Industrial Training Center with the NCVT, it would be just and proper to direct the respondents to issue the mark-sheets of the petitioners pertaining to the Examination 2011.

Consequently, the respondents Kanika Industrial Training Center and the Director Technical Education, Directorate Jodhpur are directed to issue the marksheets of petitioners of NCVT Examination 2011 in the Electronics trade.

The writ petition stands allowed accordingly. Stay application stands disposed of.
