Judgment
Petitioner, who is the legal heir of M. Meeran Rawther, has approached this Court seeking to quash Exts.P1 and P3 and to declare that the
petitioner is not liable to pay the amount demanded in Exts.P1 and P3.
The petitioner contends that his late father was a consumer of the 1st respondent-Kerala Water Authority, of a domestic water supply connection.
In the year 2002, the average monthly bills were between Rs.300/- and Rs.450/-. In the year 2018, Exts.P1 and P3 notices were served on the
petitioner demanding exorbitant water charges which, according to the petitioner, is not in tune with the actual consumption in any manner.
When this writ petition came up for admission on 17.11.2020, this Court passed an interim order staying the proceedings for recovery pursuant to
Exts.P1 and P3 on condition that the petitioner would pay a sum of Rs.20,000/- within a period of two weeks.
Learned counsel for the respondents, on instructions, submits that the petitioner has complied with the said condition of deposit of Rs.20,000/- and
the respondents are willing to consider the grievance of the petitioner if the petitioner submits a representation in that regard.
As the respondents have come forward to consider the grievance of the petitioner, this Court is of the opinion that no adjudication need be made in
this writ petition at this stage.
Accordingly, the writ petition is disposed of permitting the petitioner to file a representation before the 2nd respondent against the impugned bills within
a period of two weeks. If the petitioner makes such a representation to the 2nd respondent, the 2nd respondent shall consider the representation on its
merits, granting an opportunity of hearing to the petitioner, within a period of two months thereafter. If the petitioner submits the representation within
two weeks as indicated above, coercive proceedings against the petitioner, if any, shall stand deferred till the 2nd respondent takes a final decision on
the representation.
