Judgment
This Writ Petition is filed by the petitioner under Article 226 of the Constitution of India seeking a Writ of Mandamus to declare the action of 2nd respondent in not permitting / allowing the petitioner for first and second phase of counselling for admission into M.B.B.S. / B.D.S. Courses for the Academic Year 2022-23 under Management Quota, i.e., “B” Category in private un-aided non-minority / minority medical colleges and private un-aided dental colleges, army dental college affiliated to the 2nd respondent-University as unjust, arbitrary and unconstitutional.
Heard Mr.D. Narendar Naik, learned counsel for the petitioner; the learned Government Pleader for Medical, Health and Family Welfare, for the 1st respondent; and Mr. A. Prabhakar Rao, learned Standing Counsel for the respondent nos.2 and 3.
Learned counsel for the petitioner contended that petitioner has appeared for the National Eligibility-cum-Entrance Test, 2022 (Under-Graduate) and secured a decent rank; thereafter, the petitioner has responded to notification dated 19.10.2022, issued by the 2nd respondent-University, for admission into M.B.B.S. / B.D.S. Course for the Academic Year 2022-23 under ‘B’ & ‘C’ seats in Management Quota; however, at the time of exercising web options, the petitioner could not exercise the web option as the petitioner was hospitalized due to Dengue fever; immediately, petitioner submitted a detailed representation to the 2nd respondent-University on 06.12.2022, requesting the 2nd respondent-University to permit the petitioner to exercise web options; but the 2nd respondent-University has not passed any orders on the representation dated 06.12.2022 submitted by the petitioner; and therefore, prayed this Court to pass appropriate orders in the Writ Petition by directing the 2nd respondent-University to consider the representation submitted by the petitioner dated 06.12.2022 and pass appropriate orders thereon in accordance with law
On the other hand, learned Standing Counsel for the 2nd respondent-University submitted that since petitioner’s representation dated 06.12.2022 is pending with the 2nd respondent-University, the 2nd respondent-University shall consider the same and pass appropriate orders in accordance with law.
This Court, having considered the submissions made by the parties, is of the considered view that the present Writ Petition can be disposed of by directing the 2nd respondent-University to consider the representation dated 06.12.2022 submitted by the petitioner and pass appropriate orders thereon in accordance with law within a reasonable period of time.
Accordingly, the Writ Petition is disposed of with the above directions. No costs.
As a sequel, miscellaneous applications pending if any in this Writ Petition, shall stand closed.
