This writ petition under Article 226 of the Constitution of India is is filed by the petitioners being aggrieved of notice dated 24.11.2022, which according to petitioners is malafide because petitioner was convener of Bharat Jodo Yatra from Singrauli to Bhopal.

It is submitted that as a matter of political vendetta, firstly, he was falsely implicated in case crime No.581/2022 at Police Station Bandri, District Sagar. When he was released on bail vide order dated 22.11.2022, immediately impugned notice was issued for demolition.

Shri Manas Mani Verma, learned Government Advocate submits that there is a provision of appeal under the provisions of Section 307 read with Section 309 of the Municipalities Act, 1961.

That being so and taking over all picture of the matter, it is directed that petitioners shall file appeal within three working days from today, which will be decided by the concerned authority within a further period of 15 days.

Till then, parties shall maintain status quo as it exists today and shall not cause any damage to the property of the petitioners.

With the aforesaid observation and in view of the alternative remedy, this writ petition is disposed of.
