Hearing through video conferencing
Learned counsel for the applicant submits that the applicant was appointed as Dawasaz in the year 1961 and thereafter as Dental Technician in the
Department of Health in the year 1963. He further submits that in the year 1973, a case was registered against the applicant under Section
307/452/353 RPC and the applicant was placed under suspension. He further submits that the applicant is seeking direction to the respondents to
release the arrears of salary for the period of suspension and pension after giving all the benefits by calculating the salary as per rules. Hence, the
present O.A.
Learned counsel for the applicant further submits that the applicant will be satisfied, if a direction is given to the respondents to treat this O.A. as
representation of the applicant and take a decision on the same by passing a reasoned and speaking order within a stipulated time frame.
We have heard Mr. Jasbir Singh Jasrotia, learned counsel for the applicant and Mr. Raghu Mehta, learned SCGSC for respondent no.7 and Mr.
Rajesh Thapa, ld. DAG for the official respondents and perused the records.
Looking to the limited prayer made by the learned counsel for the applicant, we dispose of the O.A. with direction to the respondents to treat this
O.A. as representation of the applicant and dispose of the same by passing a reasoned and speaking order within a period of six weeks from the date
of receipt of a certified copy of this order. A Copy of the order shall be given to the applicant.
It is made clear that we have not entered into the merits of the case.
No order as to costs.
