Judgment
The petitioner, through the instant writ petition has sought indulgence of this Court, while working as Assistant Librarian Grade â€" I, Kerala
University Library, claiming his promotion, as he is due to retire on 31.5.2022.
Inter alia, on the pleadings that the post of Deputy Librarian in the University was at Serial No.85 in the Schedule to Kerala University First
Ordinances, 1978 (herein after referred to as ordinance). The matter of appointment to the said post is by way of promotion from the Cadre of
Assistant Librarian Grade-I. The qualification for the above post is Bachelors Degree with a Masters' Degree in Library Science or a Masters'
Degree with a Degree or equivalent Diploma in Library Science and three years experience in a Professional post in a recognized library. The
petitioner possesses all the educational qualifications of Master of Library and Information Science (MLIS), M.Phil Degree in Library and Information
Science and Ph.D in Library and Information Science. He entered service as Library Assistant in the University Library on 9.3.1994 and presently
working as Assistant Librarian Grade â€"I. The first vacancy arose on 1.6.2018 by the retirement of Smt.Sujithakumari.P.K. and thereafter two
vacancies arose by the retirement of two persons. The grievance of the petitioner is that, the University is not taking any action to fill the above
vacancies. Learned Counsel for the petitioner submits that petitioner is the 2nd qualified person in the category of Assistant Librarian. In this regard
petitioner filed a representation before the 2nd respondent, Ext.P10 dated 4.6.2020, but no action has been taken thereon. While so petitioner received
Ext.P11 communication stating that the opinion of the Standing Counsel has been sought as regards the filling up of the three vacancies of the Deputy
Librarian. Though almost five months have elapsed, no action has been taken by the respondents.
Sri.Thomas Abraham, learned Standing Counsel appearing for the Kerala University submitted that the respondents would not be averse in taking a
call on the representation submitted in this regard.
Having heard learned Counsel for the parties and appraised the paper book, without commenting on the merits of the matter, this writ petition is
disposed of with a direction to the 2nd respondent to take a call on the representation, Ext.P10, in accordance with law, as expeditiously as possible, at
any rate, within a period of two months from the date of receipt of a copy of this judgment.
The writ petition is disposed of accordingly.
