The petitioners are the accused in FIR No. 0093 dated 8.6.2020 on the file of Police Station Division No. 4, Ludhiana, registered under Sections 323, 160, 506, 427, 148 and 149 IPC.
By way of this petition filed under Section 482 Cr.P.C., they seek quashing of the said FIR.
It is the case of the petitioners that they settled their differences with the complainants, viz., respondents No. 2 and 3 herein, at whose behest the subject FIR was registered. The terms of compromise are stated to have been reduced to writing by way of compromise deed dated 19.8.2020. It is on the strength of this document that the petitioners seek relief presently.
Mr. Ashish Bakshi, learned counsel, entered appearance for respondents No. 2 and 3, the complainants, and filed his power of attorney. He affirms the factum of compromise and states that his clients have no objection to the quashing of the subject FIR.
Mr. Gaurav Garg Dhuriwala, learned Senior Deputy Advocate General, Punjab, would state on instructions that no other FIR has been registered against any of the petitioners and that the case involves only one single injury. He also states that there are no known criminal antecedents that would weigh against the petitioners.
In that view of the matter, even if the case is taken to its logical conclusion, it would only be an exercise in futility as the parties have already settled their differences. Therefore, no purpose would be served in wasting the time and resources of the State in pursuing this case to its pre-ordained end. In consequence, it would be better to give a quietus to the issue at this stage.
The petition is allowed. FIR No. 0093 dated 08.06.2020 on the file of Police Station Division No. 4, Ludhiana, registered under Sections 323, 160, 506, 427, 148 and 149 IPC, and all other proceedings relating thereto shall accordingly stand quashed.
