Present petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of Mandamus directing the
respondents to count the daily wage service of the husband of the petitioner, namely Mangal Singh (since deceased) rendered before regularization, as
qualifying service, for the purpose of pensionary benefits.
In response to notice of motion issued by this Court, short reply by way of affidavit dated 24.10.2020 along with speaking order (R-1) has already
been filed in the matter and relevant part thereof reads as under: -
“That while the order dated 09.11.2020 passed by the Hon'ble High Court in CWP-12108 of 2020 filed by Smt. Manjit Kaur widow of deceased
Constable Mangal Singh No.27/499 versus State Govt. of Punjab and others, a Demi official letter No.16029 dated 10.11.2020 issued by Deputy
Advocate General Punjab, Chandigarh, Sh. Abhaypal Singh Gill and the directions issued by the office of Director General of Police, Punjab,
Chandigarh vide his office letter No.289-23/2020/LA-2/3812, dated 03.12.2020, that the service rendered by constable Mangal Singh No.27/499 in the
rank of SPO as daily wage service w.e.f. 09.11.1993 to 22.03.200◌7 has been counted as qualifying service entitled for pension based on the
permission given by the Finance Department vide No.1/02/2017-1 /121/1, dated 24.01.2017 and letter No.11/166/16-5Home3/666, dated
30.01.2017 issued by the Punjab Government, Department of Home Affairs and Jail (Home-03 Branch) in content of orders issued by the Hon'ble
High Court for CWP No.11802 of 2008 (Paramjit Kaur versus Punjab Government).â€
Perusal of the relevant part extracted hereinabove clearly reveals that service rendered by the husband of the petitioner has been counted as
qualifying service for pensionary benefits on the basis of permission granted by the Finance Department.
In view of the above, learned counsel for the petitioner stated that her grievance has been redressed and no further directions are required to be
issued in the matter.
Disposed off, accordingly.
