Manpreet Kaur vs State of Punjab and Others

Ajai Lamba, J.—This civil writ petition has been filed under Article 226/227 of the Constitution of India, praying for issuance of a writ in the nature of mandamus, directing the respondents to consider the petitioner for appointment to the post of ETT Teacher.

It has been pleaded that an advertisement was made by respondent-Zila Parishad, Fatehgarh Sahib inviting applications for appointment to the posts of ETT Teachers in the State of Punjab. Recruitment was to be made district wise. The advertisement has been placed on record as Annexure P-1. The relevant qualification at issue in this petition is "10+2 and Diploma in Elementary Teacher Training course recognised by School Education Board of any State Government or the Central Government or a certificate of an equivalent course from the Defence Services of the Union of India".

While the petitioner asserts that she has the relevant qualification, respondent-Zila Parishad has disputed the fact.

The case set up by the respondents is that the petitioner has passed ''Primary Teachers Training Course'' and not ''Elementary Teachers Training Course''. It has further been clarified that the petitioner obtained Primary Teachers Training Course from SPG Mission College, Ranchi. The certificate presented by the petitioner and appended with the petition as Annexure P-2 was sent to the Director, SCERT, Punjab, for seeking clarification regarding qualification of the petitioner, in the context of her eligibility. Vide communication dated 22.10.2007 received from SCERT, Punjab, it has been brought out that the Institute is neither a recognised institute nor the petitioner is trained in elementary teachers training. Communication has been placed on record as Annexure R-3/1.

Learned Counsel for the petitioner has very fairly conceded that the petitioner has only taken primary teachers training course and not elementary teachers training course.

I have considered the issue.

Since the advertisement itself makes it clear that as per the eligibility criteria, a candidate needs to have Elementary Teachers Training Course recognised by State Education Board of any State Government or the Central Government or a certificate of an equivalent course from the Defence Services of the Union of India, and the petitioner does not have that qualification, the petitioner has no right to claim appointment for the post of ETT Teacher.

The petition is accordingly dismissed.
